These terms are the agreement between you and Sports Stats Limited ("we", "us") for your use of the Bakery Director app. By downloading or using the app you accept them. If you do not accept them, do not use the app.
1. Your licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to download and use Bakery Director on any Android device that you own or control, as permitted by the Google Play Terms of Service. You may use the app for your own personal, non-commercial entertainment.
You may not: copy, sell, rent, sub-licence or redistribute the app; reverse engineer, decompile or disassemble it, except where that right cannot lawfully be excluded; remove or alter any copyright or ownership notices; modify or create derivative works from it; or use it in any unlawful way.
2. Ownership
The app, its source code, artwork, text, design, game systems and the name "Bakery Director" are owned by us and protected by copyright and other laws. You are buying a licence to use the app, not the app itself. Any rights not expressly granted to you are reserved.
The app uses the Nunito typeface, Copyright 2014 The Nunito Project Authors, under the SIL Open Font License 1.1. A copy of that licence is included in the app. It covers the font only, not the rest of the app.
All bakeries, rivals, customers and businesses in the game are invented. Real cities and districts appear only as settings. Any resemblance to real businesses, products or people is coincidental.
3. In-app purchases
Bakery Director is free to play. It offers optional one-off in-app purchases that unlock extra content: the New York and Paris cities, and the Test Kitchen. London and the rest of the game are free.
- All purchases are processed by Google through Google Play. Your payment relationship is with Google, and Google's terms govern it.
- Purchases are non-consumable: you buy each one once, and it stays unlocked for every bakery you start on any device signed in to the same Google account. Use Restore purchases on the title screen to unlock them again on a new device or after reinstalling.
- In-game money, recipes and everything else in the game are not real money or property and have no value outside the game. They cannot be redeemed, exchanged, transferred or cashed out.
- Purchases are final. We cannot issue refunds. Google handles all refund requests, under Google Play's refund policy, through https://support.google.com/googleplay/answer/2479637
- If a purchase is refunded, the content it unlocked is locked again. A bakery already running in a city you no longer own can still be played.
- We may change the price or availability of in-app purchases, or stop offering them, at any time. Content you have already bought stays unlocked in the versions of the app that include it.
If you share a device or your Google account with a child, turn on Require authentication for purchases in the Google Play Store app's settings, or manage their purchases with Google Family Link.
4. Your save data
Your progress is saved locally on your device. There is no cloud save of ours and no account, so we cannot recover a lost game. Save data can be lost if you uninstall the app, reset the device, or if it becomes corrupted. Android's own backup to your Google account, if you have it turned on, is the only protection, and keeping it is your responsibility.
5. Updates and availability
We may release updates that change, add or remove features, and we may stop supporting older versions of Android. We may also stop distributing or supporting the app entirely. We are not obliged to provide updates, support or continued availability, and we owe you no refund if we discontinue the app.
6. Disclaimer of warranties
The app is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of bugs, or that any defect will be corrected.
Bakery Director is a work of fiction. Its business, pricing, loan and market simulations are designed for entertainment and are not financial, business or culinary advice. Do not make real-world decisions on the basis of anything in this game.
Nothing in these terms excludes or limits any right you have as a consumer that cannot lawfully be excluded or limited. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
7. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, lost save games, lost profits or lost purchases, arising out of your use of or inability to use the app.
Where liability cannot be excluded, our total liability to you for any claim relating to the app is limited to the greater of (a) the amount you actually paid for the app and its in-app purchases in the twelve months before the claim, or (b) £20.
8. Google
You acknowledge that:
- These terms are between you and us, not Google, and Google is not responsible for the app or its content.
- Google has no obligation to provide any maintenance or support for the app.
- Your use of Google Play, including buying the app's in-app purchases, is also governed by the Google Play Terms of Service. Where these terms and Google's differ on how Google Play works, Google's terms apply.
- If a third party claims the app infringes its intellectual property rights, we, not Google, are responsible for the investigation, defence, settlement and discharge of that claim.
9. Termination
This licence ends automatically if you break these terms. You can end it at any time by uninstalling the app. Sections 2, 6, 7, 8 and 10 survive termination.
10. Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have non-exclusive jurisdiction over any dispute. This does not deprive you of the protection of the mandatory consumer laws of the country in which you live.
11. Changes to these terms
We may update these terms when the app changes. The current version will always be at https://director.games/bakery-director/terms/android/, with the date at the top. Continuing to use the app after an update means you accept the revised terms.
